These Terms of Service apply to all products, services, digital downloads, training materials, SCORM packages, documents, templates, forms, and website content provided by CPS Safety through cpssafety.org or any related sales, delivery, or communication platform.
1. Acceptance of Terms
By purchasing, downloading, accessing, installing, using, or modifying any products or materials from CPS Safety, you agree to be bound by these Terms of Service.
If you do not agree to these Terms, do not purchase, download, access, install, use, or distribute CPS Safety products or materials.

3. Products and Services
CPS Safety provides digital safety training materials and related resources, including but not limited to:
OSHA and DOT safety training kits.
SCORM-compatible LMS training modules.
Editable PowerPoint presentations.
HTML training players and online course files.
Safety program templates and documentation.
Forms, checklists, policies, and safety support materials.
Training scripts, quizzes, knowledge checks, and instructional content.
Unless otherwise stated, CPS Safety products are delivered as digital downloads, online files, SCORM packages, or electronic training materials.
4. Digital Delivery
All CPS Safety products are provided electronically. Customers are responsible for downloading, saving, backing up, and properly installing purchased files.
CPS Safety is not responsible for loss of downloaded files after delivery, customer computer issues, third-party platform issues, LMS configuration problems, browser limitations, or customer-side technical restrictions.
5. License Grant
Upon purchase, CPS Safety grants the customer a limited, non-exclusive, non-transferable license to use the purchased materials for the customer’s own internal training purposes.
This license allows the customer to:
Install SCORM packages or HTML training files on the customer’s own Learning Management System.
Use the materials for internal employee or contractor training.
Print included materials for classroom or internal training use.
Edit PowerPoint files, forms, or templates where editable files are provided.
Train unlimited employees within the purchasing organization, unless a separate written agreement states otherwise.
Use the materials as part of the customer’s internal safety program.
6. License Restrictions
Customers and users may not:
Resell, rent, lease, license, sublicense, redistribute, or share CPS Safety materials with other organizations.
Use CPS Safety materials to provide commercial training services to third parties.
Upload CPS Safety materials to public websites, public LMS libraries, file-sharing platforms, or open-access storage locations.
Claim authorship or ownership of CPS Safety materials.
Remove copyright notices, branding, ownership statements, license terms, or legal notices.
Copy, scrape, reverse engineer, extract, duplicate, or repackage CPS Safety materials for resale or redistribution.
Share download links, source files, SCORM packages, editable files, or training content with unrelated businesses or third parties.
Use CPS Safety materials in any unlawful, misleading, unsafe, or unauthorized manner.
7. Intellectual Property
All CPS Safety content remains the property of CPS Safety unless otherwise stated.
This includes, but is not limited to:
Text.
Graphics.
Logos.
Training materials.
SCORM packages.
HTML files.
PowerPoint files.
Documents.
Forms.
Templates.
Quizzes.
Animations.
Illustrations.
Audio scripts.
Course structures.
Digital training player designs.
Purchase of a CPS Safety product does not transfer ownership of the product, source content, intellectual property, or copyrights. Customers receive only the limited license described in these Terms.
8. Customer Edits and Modifications
Some CPS Safety products may include editable files. Customers may customize editable materials for their own internal use.
If a customer edits, changes, removes, adds to, or modifies any CPS Safety material, the customer assumes full responsibility for the modified version.
CPS Safety is not responsible for compliance issues, errors, omissions, training failures, LMS problems, quiz problems, incorrect information, or damages caused by customer modifications.
9. No Refunds
Due to the digital nature of CPS Safety products, all sales are final once a product has been purchased, accessed, downloaded, delivered, or made available.
CPS Safety does not provide refunds for digital products except where required by applicable law or where CPS Safety chooses to issue a refund at its sole discretion.
Customers are responsible for reviewing product descriptions, file types, compatibility details, and requirements before purchasing.
10. Technical Support
CPS Safety may provide reasonable technical support for:
Download or access issues.
File opening issues.
SCORM package questions.
Basic LMS compatibility questions.
File format problems.
Technical support does not include:
Custom course development.
Custom edits.
Training delivery services.
LMS administration.
Regulatory consulting.
Legal advice.
Safety program management.
On-site training.
Employee competency evaluations.
CPS Safety does not guarantee compatibility with every LMS, SCORM player, browser, device, operating system, hosting platform, or software environment.
11. Training Disclaimer
CPS Safety materials are provided for general informational, educational, and safety awareness purposes only.
CPS Safety materials are not a substitute for:
Legal advice.
Professional safety consulting.
Site-specific hazard assessments.
OSHA, DOT, EPA, ANSI, NFPA, or other regulatory review.
Hands-on training.
Equipment-specific instruction.
Employer supervision.
Required certifications.
Competency evaluations.
Employers and users are responsible for determining whether the materials are suitable for their workplace, employees, hazards, equipment, operations, industry, and location.
12. Compliance Responsibility
The customer is solely responsible for:
Ensuring training meets applicable federal, state, local, industry, and company requirements.
Reviewing and updating training materials as regulations change.
Providing hands-on instruction where required.
Maintaining training records.
Verifying employee understanding.
Conducting required evaluations or certifications.
Providing site-specific policies and procedures.
Ensuring employees are trained according to applicable laws and company rules.
CPS Safety materials are intended to support training efforts but should not be used as the only basis for a complete safety or compliance program.
13. Disclaimer of Warranties
All CPS Safety products and materials are provided “as is” and “as available” without warranties of any kind, either express or implied.
CPS Safety does not warrant that:
Materials will meet every regulatory requirement.
Materials are complete for every industry, jobsite, or workplace.
Files will work with every LMS, browser, device, or software system.
Products will be error-free or uninterrupted.
Training materials will prevent injuries, citations, fines, penalties, or compliance failures.
To the fullest extent permitted by law, CPS Safety disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the fullest extent permitted by law, CPS Safety shall not be liable for any indirect, incidental, consequential, special, punitive, or other damages arising from the purchase, download, use, misuse, modification, installation, or inability to use CPS Safety products or materials.
This includes, but is not limited to:
Workplace injuries or illnesses.
Regulatory citations, fines, or penalties.
Failed audits or inspections.
Loss of business, revenue, profits, data, or training records.
LMS tracking or completion issues.
Customer modifications.
Improper training delivery.
Failure to provide required hands-on training.
Failure to comply with applicable laws or regulations.
CPS Safety’s total liability for any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
15. Third-Party Platforms
CPS Safety products may be used with third-party systems, including LMS platforms, SCORM players, browsers, hosting services, payment processors, email systems, or file storage services.
CPS Safety is not responsible for the performance, availability, security, compatibility, errors, outages, or policies of third-party platforms.
16. Account, Order, and Payment Information
Customers are responsible for providing accurate order, billing, and contact information.
CPS Safety may use the customer’s provided email address to deliver products, provide support, send order information, or communicate about purchased materials.
Failure to provide accurate contact information may result in delayed delivery or support.
17. Updates and Product Changes
CPS Safety may update, revise, improve, replace, or discontinue products or materials at any time.
Purchase of a product does not guarantee free future updates unless specifically stated in writing.
CPS Safety may also update these Terms of Service at any time. Continued use of CPS Safety products or materials after updated Terms are posted or provided constitutes acceptance of the updated Terms.
18. External Links
CPS Safety materials or website pages may contain links or references to third-party websites, agencies, standards organizations, or resources.
These links are provided for convenience only. CPS Safety does not control and is not responsible for the content, accuracy, availability, policies, or security of third-party websites.
19. Termination of License
CPS Safety may terminate a customer’s license if the customer violates these Terms of Service.
Upon termination, the customer must stop using CPS Safety materials and must delete or remove unauthorized copies, shared files, public postings, or redistributed materials.
Termination does not limit CPS Safety’s right to seek legal remedies for unauthorized use, copyright violations, or license violations.
20. Governing Law
These Terms of Service are governed by and interpreted under the laws of the State of New Mexico, without regard to conflict-of-law principles.
Any dispute arising from or related to CPS Safety products, services, website use, purchases, licensing, or these Terms shall be handled in a court of competent jurisdiction located in New Mexico, unless otherwise required by applicable law.
