CPS Safety provides digital safety training materials, online training resources, SCORM training packages, safety forms, instructional content, and related educational materials for businesses, contractors, and individual users.

2. Ownership of Content and Intellectual Property

All training materials, course content, SCORM packages, HTML files, documents, forms, graphics, animations, illustrations, quizzes, templates, written content, audio scripts, and related materials created or provided by CPS Safety are the property of CPS Safety unless otherwise stated.

This content is protected by copyright, intellectual property laws, and other applicable laws. All rights are reserved.

Customers and users may not copy, reproduce, modify, publish, upload, distribute, sell, resell, license, sublicense, share, or publicly post CPS Safety materials without prior written permission from CPS Safety.

3. Limited License for Customer Use

When a customer purchases or receives training materials from CPS Safety, the customer is granted a limited, non-exclusive, non-transferable license to use the materials for internal training purposes only.

This license allows the customer to:

Use the materials for employee, contractor, or internal workplace safety training.

Upload SCORM packages into the customer’s own learning management system for internal use.

Print or distribute related forms or materials internally, if included with the purchase.

This license does not allow the customer to:

Resell, rent, lease, or redistribute CPS Safety materials.

Upload CPS Safety materials to public websites, file-sharing platforms, or public training libraries.

Claim CPS Safety materials as their own work.

Remove copyright notices, branding, legal notices, or ownership statements.

Share access with unrelated companies, third parties, or outside organizations unless CPS Safety provides written permission.

4. Training Disclaimer

CPS Safety training materials are provided for general informational, educational, and safety awareness purposes only.

The materials are not intended to replace:

Professional safety consulting.

Legal advice.

Site-specific safety evaluations.

OSHA, DOT, EPA, ANSI, NFPA, or other regulatory compliance review.

Employer-required hazard assessments.

Hands-on training, practical evaluations, certifications, or competency verification where required by law or company policy.

Employers and users are responsible for ensuring that all training, policies, procedures, inspections, certifications, and workplace practices meet applicable federal, state, local, industry, and company-specific requirements.

5. Regulatory Compliance

CPS Safety may reference OSHA, DOT, EPA, ANSI, NFPA, or other safety standards and best practices. However, laws, regulations, and industry standards may change over time.

CPS Safety does not guarantee that all materials are current, complete, or sufficient for every workplace, jobsite, state, industry, or regulatory situation.

Users are responsible for reviewing applicable regulations and confirming that training content is appropriate for their specific operations, hazards, equipment, employees, contractors, and work locations.

6. No Warranty

All CPS Safety materials are provided “as is” and “as available” without warranties of any kind, either express or implied.

CPS Safety makes no warranties regarding:

Accuracy, completeness, or suitability of the materials for a specific purpose.

Compliance with any particular regulation or standard.

Compatibility with every learning management system, SCORM player, browser, device, or software platform.

Uninterrupted or error-free use of digital files, websites, downloads, or SCORM packages.

To the fullest extent permitted by law, CPS Safety disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, CPS Safety shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or other damages arising out of or related to the use, misuse, inability to use, or reliance on CPS Safety materials.

This includes, but is not limited to:

Workplace injuries or illnesses.

Regulatory citations, penalties, or fines.

Failed inspections or audits.

Loss of business, revenue, profits, data, or training records.

Learning management system issues.

Incorrect implementation of training materials.

Failure to provide required hands-on training or site-specific instruction.

In no event shall CPS Safety’s total liability exceed the amount paid by the customer for the specific product or service giving rise to the claim.

8. Customer Responsibility

Customers and users are responsible for:

Reviewing all materials before use.

Customizing materials to match their company policies and jobsite hazards.

Providing additional hands-on instruction where required.

Verifying employee understanding and competency.

Maintaining training records.

Ensuring compliance with applicable laws, regulations, and company requirements.

CPS Safety materials should be used as a training aid and not as the sole basis for a complete safety program.

9. Third-Party Platforms and Technical Compatibility

CPS Safety materials may be used with third-party systems, including learning management systems, SCORM players, browsers, hosting platforms, or software tools.

CPS Safety is not responsible for errors, failures, display issues, reporting issues, completion tracking problems, or technical limitations caused by third-party platforms, customer systems, software updates, browser settings, hosting environments, or user modifications.

10. External Links

CPS Safety websites or materials may include links to third-party websites or references to outside organizations. These links are provided for convenience only.

CPS Safety does not control and is not responsible for third-party websites, content, policies, accuracy, availability, or security.

11. User Modifications

If a customer modifies CPS Safety materials, the customer assumes full responsibility for the modified version.

CPS Safety is not responsible for errors, omissions, compliance issues, technical problems, or training failures caused by customer edits, removed content, altered quizzes, changed instructions, or modified SCORM files.

12. Prohibited Use

Users may not use CPS Safety materials for unlawful, misleading, harmful, or unauthorized purposes.

Users may not attempt to reverse engineer, extract, copy, scrape, duplicate, or repackage CPS Safety content for resale or redistribution.

Users may not remove copyright notices, ownership labels, branding, license terms, or legal disclaimers from CPS Safety materials.

13. Governing Law

This Legal Notice shall be governed by and interpreted under the laws of the State of New Mexico, without regard to conflict-of-law principles.

Any dispute arising from or related to CPS Safety materials, services, website use, purchases, or licensing shall be handled in a court of competent jurisdiction located in New Mexico, unless otherwise required by applicable law.
